Terms of Sales
ARTICLE 1: EFFECT OF THE CONTRACT
The various provisions of this contract “charter mandate” gives mandate by the customer to LA CONCIERGERIE NAYA, to reserve a device for him take effect, upon reservation by email or telephone from the chartering customer. The absence of signature of the contract or non-return by the customer does not constitute an absence of consent.
The final confirmation of the device with the selected company can only be made upon receipt by return email of the signed contract. Any delay in sending the signed contract cannot be held against LA CONCIERGERIE NAYA, in the event of unavailability of the device upon receipt, which confirms the firm reservation of the device.
– Any cancellation following written reservation confirmation by email or telephone will result in a minimum cancellation penalty of 30% according to the conditions of article 7 below.
– Any change of device requested by the customer after confirmation of a particular device, may result in cancellation penalties as indicated in article 7, if the company of the first confirmed device cannot provide a corresponding device from its fleet. to the new request, or resulting in a change of charterer, to satisfy the new request for the device desired by the customer.
ARTICLE 2: MODIFICATIONS TO THE FLIGHT
This charter mandate contract may not be extended or modified without the customer having obtained the prior agreement of CONCIERGERIE NAYA, which will give all useful instructions to the crew or the subcontracting carrier. Except in urgent or exceptional cases, the crew is not authorized to receive instructions from the client. Any modification to this contract will be subject to additional invoicing, a credit note or a forfeit on the basis of the current tariff. the carrier will be responsible for the smooth running of the mission.
ARTICLE 3: SCHEDULES – DIVERSIONS – CANCELLATION
The schedules planned and accepted by the customer are only given as an indication. The company CONCIERGERIE NAYA or the subcontracting carrier reserves the right to modify them or cancel all or part of the flight for reasons of safety, air traffic, weather conditions or technical imperatives or authorizations. In the event of unavailability of the aircraft for technical reasons before the flight, or during the flight, LA CONCIERGERIE NAYA cannot be held responsible. LA CONCIERGERIE NAYA will do everything possible with the carrier to find a replacement device of the same or smaller size as far as possible. Any additional cost, if not borne by the subcontracting carrier, according to its conditions of sale, will be borne by the customer, who accepts it accordingly.
LA CONCIERGERIE NAYA or the Carrier shall not be liable for any damage, loss or loss of profit suffered by the Charterer or passengers due to the failure to perform the flight in accordance with the flight schedule caused by force majeure, including but not limited to enforced quarantine, aircraft breakdown, riots, airport strikes preventing aircraft from departing, disruption, hazards due to risks of war or due to other natural disasters (force majeure). The Carrier will not be responsible for any damage, loss or delay caused by airport employees or persons who are not under the control of the company or LA CONCIERGERIE NAYA and cannot be the subject of a claim. flight reimbursement.
Helicopter flights are reimbursed without penalty, if the weather conditions do not allow the flight to be made from the base of the aircraft. It will only be charged for the return set-up of the aircraft at its base, if the set-up of the aircraft for the flight requested takes place on another location or departure area than its base.
ARTICLE 4: INSURANCE
The carrier insures its planes according to the general conditions of the Montreal or Warsaw conventions depending on the company. The customer remains free to take out additional individual insurance.
ARTICLE 5: MANDATORY IDENTITY DOCUMENTS
As part of anti-terrorist procedures, it is mandatory to provide LA CONCIERGERIE NAYA, 48 hours before the flight, with scanned copies of the passengers’ identity documents. Failure to do so may result in the authorities refusing to board and a fine of up to €5,000 per passenger.
ARTICLE 6: PAYMENT TERMS AND CONDITIONS OF PAYMENT
– Full payment is made when confirming the reservation for the service to be set up. Payments are made by bank transfer.
– The change of company after written confirmation and contract signed with a sub-contracting company may lead to cancellation penalties on the part of the latter if the flight is canceled for an aircraft of different capacity to the one proposed that it does not have or if the customer decides to cancel the outward and return mission with this same company for any reason whatsoever on the part of the customer or the company itself for technical reasons.
– Reminder of the general conditions of sale: Invoices are payable upon receipt unless otherwise agreed. If the payment date is exceeded and in accordance with article 53 of the NRE law n° 2001-420 of 05/15/2001, penalties will be applied for late payment of (3) three times the legal rate in force on the amount including tax pro rata temporis.
– The rate of late payment penalties due from the day following the payment date appearing on the invoice must be mentioned by this invoice
(Article L 441-3 of the Commercial Code).
ARTICLE 7: CHARGES FOR CANCELLATION
Time between the date of confirmation or cancellation and the date of departure of the flight:
Amount to be paid to LA CONCIERGERIE NAYA:
More than 60 days before the day of the flight: 30%
From 60 days to 30 days before the day of the flight: 40%
From 30 days to 7 days before the day of the flight: 50%
From 48 hours to 00 hours flight day: 100%
Any refusal to pay the penalties due will result in the invoicing of the penalties equal to 100% in addition to the legal costs.
ARTICLE 8: DELAY IN BOARDING
Passengers will be present for boarding between 2:00 and 20 minutes before departure time depending on the information stipulated on the flight plan and the type of aircraft confirmed. Any delay caused by the passengers will engage the responsibility of the customer with respect to the carrier, if the latter had to pay an additional airport tax or causes a delay for the next flight of the subcontracting carrier, will be invoiced to the customer.
ARTICLE 9: LUGGAGE
The maximum weight per person allowed in a business jet is 10/15 kg (in standard sizes) to 20 kg on large capacity wide cabin type aircraft. Passengers are reminded to bring soft luggage on small business aircraft if used at full capacity. Under no circumstances can LA CONCIERGERIE NAYA or the sub-contracting carrier be held liable in the event of excess or dimension of luggage that does not allow their transport. Nor for loss and damage to baggage due to passenger negligence.
ARTICLE 10: FUEL
Fuel: Any increase in fuel of + 5%, compared to the initial price sold, may result in additional invoicing from the company.
ARTICLE 11 : DISPUTE
Any dispute on the interpretation or execution of this contract will be the jurisdiction of the courts of Lille.
